HORIZONTE ESTUDIO · ALHAURÍN DE LA TORRE
Terms of Service
Purpose and scope
These terms govern the contracting of products and services offered by Horizonte Estudio, including, among others, graphic design, printing, vinyl graphics, vinyl, posters, signs and illuminated elements, 3D lettering, wayfinding, banners, advertising media, product and garment personalisation, installation, web design, visual identity, advertising and other related work.
Acceptance of a quote, order or commission implies acceptance of these terms, unless the relevant quote expressly establishes different specific conditions.
Requests and quotes
Requests made through the website, email, WhatsApp, telephone or any other means are informational and do not in themselves imply acceptance of the job.
Work will be considered contracted when the customer expressly accepts the quote or unequivocally confirms the commission and, where applicable, pays the requested deposit.
Each quote will determine the scope of work, quantities, materials, measurements, finishes, installation, transport, price, taxes, payment method and other applicable specific conditions.
Unless expressly indicated, any service, material, travel, installation, removal, repair, adaptation or work not included in the quote will be charged separately following customer acceptance.
Quotes will remain valid for the period stated in them. Once that period has elapsed, Horizonte Estudio may review prices, material availability and timeframes.
Measurements, information and details supplied by the customer
Customers are responsible for checking that the measurements, quantities, texts, telephone numbers, addresses, prices, names, logos, images, corporate colours and other information they provide are correct.
Where measurements are supplied directly by the customer and Horizonte Estudio has not carried out an on-site survey or check, any error arising from those measurements will be the customer’s responsibility.
If incorrect information or measurements make it necessary to repeat, modify or adapt work, the corresponding costs will be borne by the customer.
Designs, drafts and final artwork
Where work requires design or graphic preparation, Horizonte Estudio may provide the customer with a proof, draft or final artwork for approval.
Approval of the design by any means allowing a record to be kept—including email or instant messaging—authorises its production.
Customers must carefully review text, spelling, telephone numbers, addresses, measurements, proportions, colours, logos, images and all other elements before approving the design.
Once final artwork has been approved, Horizonte Estudio will not be responsible for errors present and visible in the proof approved by the customer.
Changes requested after approval may incur additional costs and alter the originally planned timeframes.
Unapproved drafts, proposals and designs may not be used, reproduced or provided to third parties without express authorisation.
Files supplied by the customer
Customers must provide files of appropriate quality and resolution for the requested use.
Horizonte Estudio may point out obvious resolution, proportion or quality defects, but cannot guarantee detection of every error in customer-supplied files.
Printing or manufacturing from a file expressly supplied or approved by the customer implies acceptance of its characteristics.
Horizonte Estudio will not be responsible for loss of quality, pixelation, defects, typographical errors or results arising directly from unsuitable or incorrect original files supplied by the customer.
Rights over images, trademarks and content
Customers declare that they have the rights, licences and authorisations necessary to use the texts, photographs, illustrations, logos, trademarks, typefaces and other content they supply for the work.
Horizonte Estudio will not be responsible for third-party claims arising from customer-provided materials whose use was not duly authorised.
Colour and reproduction
Customers accept that reasonable differences may exist between colours viewed on a screen, previous prints, samples and the final result due to differences between devices, colour profiles, inks, materials, lighting and manufacturing processes.
Where particularly precise reproduction of a corporate colour is needed, this must be stated before production and may require a physical proof or specific procedure quoted separately.
Minor tonal variations inherent in printing and manufacturing processes will not in themselves be considered a product defect.
Materials and manufacturing tolerances
Printed, cut, signmaking and custom-manufactured products are subject to the technical tolerances inherent in each process and material.
Minor reasonable variations in cutting, positioning, dimensions, tone, finish or registration may occur without substantially affecting the product’s purpose.
Materials may show slight differences between manufacturing batches.
Where a particular material becomes unavailable, Horizonte Estudio may propose an alternative with equivalent characteristics and quality before using it, where the change is relevant.
Installation and surface condition
Where the service includes installation, customers must provide access to the work location and ensure surfaces are in a suitable condition to receive the product.
The adhesion and durability of vinyl, adhesives and other elements depend on the condition, composition and previous treatment of the surface.
Horizonte Estudio will not be responsible for problems caused by damaged, damp, dirty, rusty, repainted, porous or improperly cured surfaces, deteriorated paint, silicones, waxes, repellent treatments or any pre-existing circumstance not attributable to the work carried out.
If installation reveals circumstances not previously visible that prevent work continuing under suitable conditions, Horizonte Estudio may suspend installation until the appropriate solution has been agreed with the customer. Additional work or travel may be quoted separately.
Removal of vinyl, signs and existing elements
Removing previously installed materials may reveal colour differences, adhesive residue, damage, repairs, marks, weakened paint or other pre-existing defects.
Horizonte Estudio will exercise reasonable professional care, but will not be responsible for damage arising from the previous poor condition of the substrate, paint or surface where this could not be identified before starting the work.
Repairs, extraordinary cleaning or preparation needed following removal and not initially included will be quoted separately.
Vehicles
For vehicle graphics work, vehicles must be supplied reasonably clean, dry and free of waxes, silicones or other products that could impair adhesion.
Existing damage, repainting, repairs, rust, defective clear coats or paint problems may affect the result and particularly future vinyl removal.
Horizonte Estudio will not be responsible for paint lifting or defective finishes caused by adhesive removal where there is pre-existing repair, repainting, deterioration or a paint-adhesion defect.
Signs, lighting and electrical installations
Where work includes illuminated or electrical elements, the guarantee will apply according to the nature of the supplied components and applicable legislation.
Damage caused by third-party interference, defective external electrical installations, power surges, moisture or leaks from elements unrelated to the sign, impacts, vandalism, subsequent building work or use contrary to the product specifications will not be covered.
Modifications, repairs or interference by third parties may affect the guarantee where causally linked to the fault claimed.
Timeframes
Timeframes communicated are good-faith estimates based on workload, material availability and job characteristics, unless a binding date is expressly agreed in writing.
The timeframe will begin when Horizonte Estudio has all necessary information, the design has been approved and, where applicable, the agreed deposit has been received.
Delays caused by lack of response, changes, errors, missing documentation or pending customer approvals will shift the planned timeframes proportionately.
Horizonte Estudio will not be responsible for delays caused by circumstances beyond its reasonable control, including supplier or carrier delays, unforeseen material shortages, significant breakdowns, weather conditions preventing exterior installation, access restrictions or force majeure.
In such cases, the customer will be informed and the work rescheduled as soon as reasonably possible.
Changes during the work
Any change requested by the customer after accepting the quote may alter the price and timeframes.
Where a change involves redoing designs, obtaining new materials, repeating production, dismantling elements or carrying out additional work, those costs will be quoted or communicated before execution wherever possible.
Cancellation of personalised work
Work manufactured to the customer’s specifications or clearly personalised is produced specifically for each commission.
Once specifically contracted design work, acquisition of specific materials, printing, manufacturing, production or any other cost-generating stage has begun, customer cancellation may require payment for work actually completed, materials purchased and other costs reasonably incurred up to that point.
The foregoing applies without prejudice to consumers’ and users’ non-waivable legal rights.
Right of withdrawal
Where legally applicable, consumers will have the right of withdrawal under the terms and time limits established by current legislation.
Under consumer and user legislation, the right of withdrawal does not apply, among other legally specified cases, to the supply of goods made to the consumer’s specifications or clearly personalised.
Services whose performance begins during the withdrawal period at the consumer’s express request are subject to the corresponding legal regime. Once the service has been fully performed, the right of withdrawal may be lost where the legally established requirements are met.
This exception may affect, among others, certain printed products, vinyl graphics, posters, personalised garments, signs, panels, vinyl and other products manufactured specifically according to the customer’s instructions.
Delivery and collection
Customers should check the work’s condition at delivery or collection wherever possible.
Any apparent issue must be reported to Horizonte Estudio as soon as reasonably possible, accompanied by photographs or sufficient information to assess its origin.
Where a defect is attributable to Horizonte Estudio, the remedies and guarantees provided by law will apply according to the nature of the product or service.
Products supplied by the customer
Where Horizonte Estudio prints, personalises, handles or installs on garments, objects, materials or substrates supplied by the customer, the customer accepts the risks inherent in working on an item not supplied or previously tested by Horizonte Estudio.
Horizonte Estudio will be liable for damage directly attributable to it under applicable legislation, but not for defects arising from the composition, condition, incompatibility, previous deterioration or unforeseeable behaviour of customer-supplied material.
Where the item has a particularly high value, customers must communicate this before work begins.
Web design and digital services
For web projects, the quote will determine the pages, features, content, integrations and services included.
Additional changes or features requested subsequently may be quoted separately.
Customers will be responsible for reviewing and approving published texts, prices, commercial information, photographs and other content.
Unless expressly contracted, subsequent maintenance, updates, hosting, domain registration, SEO positioning, advertising campaigns, social media management or ongoing support are not included.
Horizonte Estudio cannot guarantee specific search engine positions, commercial results, numbers of visits, sales, followers, contacts or any other result dependent on platforms, algorithms or third parties.
Third-party services—domains, hosting, social networks, advertising platforms, plugins, applications, gateways or other providers—are also subject to their own terms and availability.
Intellectual property in creative work
Unless expressly agreed otherwise, payment for design work gives the customer the right to use the final delivered result for the contracted purpose.
Delivery of editable files, source files, working resources, templates or intermediate elements is not included unless expressly stated in the quote.
Third-party rights incorporated into the design—such as typefaces, stock photographs, software or other licensed resources—remain subject to their respective licences.
Photographs of completed work
Unless the customer expressly objects or a duty of confidentiality exists, Horizonte Estudio may photograph the final result of completed work and use those images as examples of its professional activity in its portfolio, website, social networks and own commercial communications, always respecting applicable legislation and avoiding disclosure of confidential information or unnecessary personal data.
Customers may communicate at any time that a particular job must not be used for portfolio or promotional purposes.
Prices and taxes
Applicable prices and taxes will be those indicated in each quote, invoice or commercial document.
Additional work not initially included will be invoiced separately following acceptance where appropriate.
Payment method
Payment method and deadlines will be those established in each quote or invoice.
Horizonte Estudio may request deposits to reserve production, acquire materials or start personalised work.
Final delivery, installation, publication or commissioning may be conditional on fulfilment of agreed payments where so established in the quote.
Non-payment
In the event of failure to meet payment deadlines, Horizonte Estudio may suspend pending work and claim overdue amounts in accordance with applicable legislation.
Where the customer acts as a business or professional, legally prescribed late-payment interest and recovery costs for commercial transactions may apply.
Guarantees and complaints
Horizonte Estudio will be responsible for products and services carried out in accordance with current legislation.
The guarantee will not cover damage caused by improper use, accidents, impacts, vandalism, third-party interference, incorrect maintenance, unsuitable chemicals, extraordinary conditions, normal wear or causes external to the product or service provided.
A complaint does not in itself authorise third-party intervention, repair or replacement of the work before allowing Horizonte Estudio to inspect the issue, unless there is an urgent need or it is legally appropriate.
Liability
Horizonte Estudio will be liable for damage directly attributable to a breach of its obligations under the terms established by applicable legislation.
Nothing in these terms is intended to exclude or limit consumers’ and users’ legal rights or liabilities that cannot be excluded by contract.
Communications and acceptance
The parties may use email, instant messaging or other customary electronic means to send quotes, files, designs, modifications, approvals and other work-related communications.
Acceptances and authorisations given by these means may be used as a record of the customer’s instructions.
Applicable law
Relationships between Horizonte Estudio and its customers will be governed by Spanish law.
Where the customer qualifies as a consumer or user, any dispute will be submitted to the courts and tribunals competent under applicable mandatory legislation.
Where the customer acts as a business or professional, the agreement between the parties and legally applicable territorial jurisdiction rules will apply.
Amendments to these terms
Horizonte Estudio may update these terms to adapt them to legal or technical changes or changes in its services.
Each job will be subject to the terms in force when contracted, together with the specific conditions set out in the relevant quote.
